This website is the property of and operated by legero united digital GmbH (hereinafter also "legero", "we", "us"). The registered business address is: Legero-United-Straße 4, AT-8073 Feldkirchen bei Graz.

Section 1 General

These general terms and conditions (hereinafter also "GTC") apply to all business relations between consumers pursuant to the Consumer Protection Act (hereinafter also “you” and “the customer”) and legero, which take place via the online shops of legero, Think! and superfit
(www.legero.com, www.thinkshoes.com, www.superfit.com). The version valid at the point of contract completion, which is accessible to the customer, applies. Delivery of ordered goods takes places exclusively to the countries listed under § 4 Delivery, cost of returns.

Alternative dispute resolution pursuant to Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at https://commission.europe.eu/strategy-and-policy. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

In placing an order with legero, you agree to the application of these GTC to your order. Please read the GTC carefully before placing an order.

Differing customer GTC are hereby expressly excluded.

Section 2 Conclusion of the contract

1. In ordering the goods by clicking on the “Buy now” button, the customer submits a binding offer to conclude a sales contract. The customer shall swiftly receive confirmation of receipt of the order by email, as well as withdrawal instructions. This does not count as an acceptance of the offer, but merely informs you of the receipt of the correct order information. The contract is only concluded upon express acceptance by us. The acceptance or rejection of the customer’s offer is carried out by sending a declaration of acceptance or rejection to the customer by email, to the customer’s specified email address. The customer is bound to their offer for 7 working days (whereby Saturday does not count as a working day).

2. We shall save the contract text and send you the order details by email. The GTC can be viewed at any time on our website. You can view previous orders in your customer account.

3. legero is entitled to reject the order if you are in a state of personal bankruptcy. In these circumstances, we will inform you by email within 3 working days (whereby Saturday does not count as a working day). Should you have already made an advance payment for the undelivered goods, then this shall of course be refunded to you.

Section 3 Prices

Only the prices shown in your shopping basket directly before concluding your order are valid for items ordered in the online stores for the brands Think!, legero & superfit. The prices include the legal VAT of the selected delivery country.

Section 4 Delivery, cost of returns

1. The ordered goods shall be delivered to the delivery address provided by the customer.
Our current delivery countries are Austria, Germany, Italy, Belgium, Estonia, Finland, France, Greece, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Portugal, Slovenia, Spain (excluding the Canary Islands), Czech Republic and Denmark.

2. On our website you will find information about the availability of products sold by legero. Delivery to Austria and Germany takes 2-5 working days. Delivery to all other countries takes 4-7 working days. If legero finds during the processing of your order that products you have ordered are unavailable, you shall be informed about this via email. Your legal rights shall remain unaffected.

3. An order can currently contain a maximum of 8 items and the maximum order value is € 1,000 per order.

4. If, through no fault of our own, we do not have the ordered goods available for delivery in our warehouse, because a supplier commissioned by us has not fulfilled their contractual obligations, we are entitled to withdraw from the contract with the customer. In this case, the customer shall be immediately informed that the ordered goods are not available. If the purchase price has already been paid, this shall be refunded immediately.

5. The legal rights of the customer shall remain otherwise unaffected.

6. Our shipping costs are €4.90 for deliveries to Austria and Germany, regardless of the order value. For all other delivery countries, the shipping costs are € 9.90. For Think! orders, shipping is free for orders above € 50.00.
Items can be cancelled within 14 days of receipt and returned within a further 14 days.

Section 5 Conditions of payment

1. Depending on your country and availability, the following payment methods are available in our online shop: credit card (MasterCard, Visa), Apple Pay, Google Pay, eps transfer, PayPal, direct debit, invoice, instalment, iDEAL and Bancontact. We reserve the right to offer individual payment methods only for certain countries or orders.

2. For purchases made by invoice, the payment term is 10 days after receipt of the invoice. The invoice will be sent to the email address provided. All payment details will be sent in a separate email from the payment service provider Unzer Austria GmbH.

3. Instalment payment is available for orders with a minimum order value of € 100.00. You will receive the payment plan and all related information by email to the address provided.

4. We reserve the right to change the types of payment methods accepted by us or to not offer individual payment methods for certain orders.

5. Payment processing is carried out via the payment service provider Unzer GmbH. In addition, the General Terms and Conditions of Unzer GmbH apply. For certain payment methods, customers will receive additional payment information directly from Unzer by email, in addition to the documents provided by legero united.

§ 6 Right of withdrawal, withdrawal policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the last item.

To meet the withdrawal deadline, it is sufficient for you to send notification of your exercise of the right of withdrawal before the withdrawal period expires.

by means of a clear statement (e.g. a letter sent by post or an email) informing us of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory. If you make use of this option, we will send you confirmation of receipt of such a withdrawal without delay (e.g. by email).

You may also exercise your right of withdrawal online via our withdrawal. If you use this online function, we will immediately send you a confirmation of receipt by email, containing details of the content of the notice of withdrawal as well as the date and time of its receipt.

Consequences of withdrawal

f you withdraw from this contract, we shall refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will make this refund using the same payment method you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return the goods without delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract, to:

The deadline is met if you post the goods before the end of the fourteen-day period.

We will bear the cost of returning the goods. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling the goods beyond what is necessary to check their condition

Please ensure you use only our returns label for your return. Parcels without this label may not be correctly identified or processed. We cannot therefore guarantee that your return will be processed smoothly. We will not accept unstamped parcels, and these will be charged to the sender.

Section 7 Warranty, liability

1. The statutory warranty conditions apply. We also offer a one-year guarantee on GORE-TEX products with regard to their waterproofness. We do not give any commercial guarantees to our customers.

2. legero is not liable for minor negligent breaches of duty, as far as these do not concern damages arising from injury to life, the body or health, any guarantees that have been granted or claims under the Product Liability Act. This also applies to breaches of duty by any vicarious agents.

Section 8 Customer account

We reserve the right to close customer accounts if we have obtained a judicial execution title against the customer account holder due to there being more than one outstanding invoice.

Section 9 Final provisions

Austrian law shall exclusively apply, excluding application of the UN Convention on Contracts for the International Sale of Goods. Irrespective of this, you are also protected by all legal, mandatory protective provisions (in particular consumer protection rights) that would apply without this choice of applicable law. Besides the jurisdictions that you are entitled to by law, you can also bring a complaint against us under this contract before the competent court in Graz-Ost.
